Abstract

This research examines the impact of illicit gains on public employees, a dimension of administrative and financial corruption. In order to confront this aspect of corruption that affects the public office, the legislator has established a law whose purpose is to protect public money and punish the employee who commits this crime, and to clarify the position of the Iraqi legislator and comparative legislation on the impact of prosecuting the public employee who enriches himself at the expense of public funds and is held accountable in a disciplinary and criminal manner and the money he obtained as a result of that illicit gain is recovered, and the extent of the adequacy of the legal texts in this regard, as we followed the descriptive analytical approach the comparative approach is based on our conviction of the necessity of this for our topic, as it opens up a wider field for us. The study reached results, the most important of which was that Islamic law preceded positive laws and international conventions in criminalizing illicit gains we also concluded that some texts in the Integrity and Illicit Gains Commission Law need to be amended The study also recommended a number of recommendations, the most important of which was to take remedial measures in the legislative and economic fields, emphasizing the role of public employees while simultaneously improving their standard of living.
